He's actually listed as "Unindicted co-conspirator #1". So it's literally just a matter of time.
Because tying Trump into the same trial would slow down the entire process of getting the rest put away. They're going after the low-hanging fruit first.

Either they think it's fine to commit crimes because getting their own is all that matters, or they don't actually care and they're just trying to piss you off by arguing. Or both.
