On October 9, 2026, the Alabama Supreme Court affirmed that dismissal in a 13‑page, unsigned opinion. The justices held that a party nominee “does not exercise any public office” and therefore is not subject to quo warranto. The court concluded the Montgomery Circuit Court “lacked subject‑matter jurisdiction” over the case.

Key legal points

  • No public office status: The court said nomination for election does not confer sovereign governmental functions, so quo warranto is not available against such nominees.
  • Jurisdictional bar: The lower court’s lack of authority was the decisive factor; the Supreme Court did not address the residency claim itself .
  • No precedent: Alabama law has no case directly allowing quo warranto to challenge a certified nominee’s eligibility before the general election.

Reactions

Plaintiffs’ attorney Barry Ragsdale called the decision “disappointing but not surprising” and said it “opens the door to ineligible candidates, including non‑U.S. citizens” if parties fail to vet nominees Tuberville’s campaign and attorney Joe Espy welcomed the ruling, framing it as a proper application of the law.

Background

Tuberville, a Republican gubernatorial nominee and U.S. senator since 2021, has faced long‑running questions about his residency. He denies the allegations, claiming he has lived in Auburn since 2018. The lawsuit cited media reports of a Florida property and other records, but Tuberville’s campaign said the Auburn home was added to his name in 2024.

In short: The case is dismissed on jurisdictional grounds, and the Alabama Supreme Court confirmed that quo warranto cannot be used to challenge a party nominee’s eligibility before the general election

Yeah, but that also means that if a Democrat tries the same thing, the Alabama Supreme Court will have to allow it by virtue of their own precedent I'm kidding this is a one-way ruling.

I mean, the democrats can run Obama for governor next time now. State Constitution be damned!

So their argument is that the state constitution bars an outsider from being governor, but says nothing about elections. In other words, the people need to sue again when he inevitably wins and see what their excuse is that time.

So guess who had a meeting with Trump this week? That's right, everybody's favorite Election Denier Tina Peters! Naturally, conversation centered around ways to seize ballots with the intention of overturning the election and the possibility of civil war.

Hey, if it's a civil war they want, I'll be happy to give it to 'em.

I look forward to seeing the MAGAts' faces when they realize they're not the only ones who own guns.

wonko the sane?

You may test that assumption at your convinience.

Where in the emotional regulation and self discipline of normal people will make the difference.

Well, only most of them. Plus they have the military and the police on their side.
No, they don't.
Like any other group made of people there is a wide variety of opinions.
Look at ICE. Most law enforcement cannot stand these guys. They make everyone who wears a badge look bad. They hate what Trump has done to the national conversation.

There will be some for and some against. I wouldn't bet nearly as much being for.

In fact, I wouldn't be surprised if the demographics were mostly on parr with the entire population.

The DoJ claims up to 250k registered voters in CA+NV+NJ+PA are non-citizens. If that's true and they're all in CA and they all vote and they all vote the same way, that could swing a vote by 1.1-1.6% (CA has 23.2M registered voters; 16.1M voted in 2024). CA has no senate races this cycle and the Dem gubernatorial candidate leads the polls by 16.1%.
"I have serious doubts about the reliability of your data and accuracy of your claims, since my office has not shared our statewide voter registration list with DHS or any other federal agency or official," [CA Secretary of State] Weber said …

The Republican administration claimed Nevada had 1,500 noncitizen voters on its voter rolls. But after the federal government identified them to the state, the number of actual registered noncitizens turned out to be zero.

Yet another reason to not mail in your ballot, from my facebook feed (and this is legit-I live in this area and my mail delivery has been screwed up all week):

Don't blame the mail carriers !!!!!!
For the THIRD TIME THIS WEEK the mail coming into Bryan from the Michigan distribution center has been late arriving. Too late for mail to be sorted and disbursed to carriers trucks / cars. My new driver's license was supposedly in Tuesday's mail according to the USPS site I follow. It didn't show up. Confusing a bit but I figured it would be here Wednesday. No worries. It didn't come Tuesday or Wednesday as ( for the second time ) the truck out of Michigan was late arriving in Bryan.
Today is Friday. Again no license. The Michigan truck was NOT in Bryan when I spoke to my carrier as of 11am !! Third none arrival at the normal time this week.
Somewhere out there floating around in mail lala land is my driver's license and a lot of other people's mail they are probably waiting on.
TO MAKE IT REAL CLEAR...this is NOT a Bryan Ohio post office problem. It's the Michigan distribution center that is totally hugging up our mail delivery. Please don't be mad at your carrier...they are frustrated too !!!
We will see what tomorrow brings.

I live in a county in California that voted for Trump in 2024. And just to dispel the stereotype, more people voted for Trump in California in 2024 than in Alaska, Wyoming, North Dakota, South Dakota, Montana, West Virginia, Nebraska, Idaho, Arkansas, Utah and Kentucky combined. We're a blue state, but I'm still surrounded by chuds.

I received my mail-in ballot a couple of weeks ago, completed it, signed/sealed it and deposited it in my mail room's outbox early last week. I was able to track it via https://california.ballottrax.net and it was just received by the county elections office on 10/16.

So Trump wasn't able to disenfranchise me, at least. Hopefully voters in Georgia and Texas will be able to say the same.
