I watched the raw video so you don't have to.
First of all, There is just no evidence of a perceived threat due to prior criminal history. Officer Dumbass appears to be the only one who drew a weapon at all. The others seem to have thought they could handle the guy. Oh and one of them can be heard saying "You have a warrant" so they knew. If it didn't scare them, it is irrelevant. Don't let them retcon this, and don't retcon it on this cop's behalf.
Secondly, this wasn't quick-draw blam. Officer Dumbass had a disturbingly long time to figure out which weapon she'd grabbed. Even if she cannot remember left and right and has been blowing off ever training with her weapons in her entire career, she should have been able to avoid this mistake.
There is not a single excuse. This cop should be prosecuted.
I watched the same damn video. The warrant would popped up in their system. The warrant was either for owning a gun illegally and/or waiving a gun in the air wildly then fleeing for police.
Either of which considering how much this guy was thrashing officer dumbass might have paniced and committed manslaughter.
I have not been saying not to prosecute, but manslaughter is an more accurate term unless someone found a criminal master plan to hunt down and murder this one specific individual.
Weird way of spelling Murder in the First Degree.
Oh? has someone found evidence the officer personally knew the victim and planned to shoot him at this particular stop like some lampoonish cartoon plot?
First Degree Murder is specifically when someone lays in wait or plans to murder someone.
That's why roughly only half of First Degree Murder arrests actually get charged as that crime after court. Its a very -specific- crime.
Again, Im not saying she was not in the wrong, Im saying she should be convicted. But words mean things and so do criminal charges. They have specific definitions for a reason.
There's a reason people who commit first degree murder get death penalty or life in prison without the possibility of parole.
