Well the consent part comes from the fact that she was too drunk to actually consent to anything reguardless of what age she was. She couldn't consent because she wasn't conscious enough to consent. The fact that HE gave an under-age person alcohol to get her into that state is what makes the whole situation MUCH worse and extremely predatory.
