"All consumers should know that piracy is illegal and that modifying their Xbox 360 console to play pirated discs violates the Xbox Live terms of use, will void their warranty and result in a ban from Xbox Live,” Microsoft said in a statement.

The Entertainment and Leisure Software Publishers' Association has suggested that piracy may cost the videogame industry as much as £750 million a year.

Problem is, though, they assume that anyone who's modded their system is doing so for piracy reasons.

Some people "mod" their system to add better heat sinks; turns out that one of the leading causes of the whole "red ring of death" is the 360 having insufficient heat sinks and thus cooking itself after extended periods of operational time.

As such, I could potentially see someone trying to sue to get access back.

TOS would mean the suit gets thrown out of court before it ever gets off the ground, though.

I can say mine hasn't for two reasons.
1. I've not modded mine
2. I don't really use Xbox Live much, Silver account that I occasionally use to download demos/game videos. I'm not one for multiplayer.

I suppose that all depends on how the system registers a mod. Throwing heat sinks in the unit doesn't affect the layout or function of the circuits. If all they do is ping the system and compare it to a baseline, heatsinks won't even show up. If they have a sensor which shows if the box has been opened and nothing on their records to say that they did it, then its unfair to the people who mod it for longevity.

Frankly, if you're stupid enough to drop in a modchip AND pay for a gold membership, they you earn what you deserve. I mean, once you buy it, its yours, mod it all you want. Mod chips, paint job, heat sinks and see-through plastic cases, just don't be cocky enough to think you can get away with playing a pirated game online. Someone will catch your ass eventually.

Pirate games i can understand but imported games? Come on.

Looks like I won't be modding the X-Box I get when I move to America to play the games I have here.

I'm thinking this is a good time to pick up a used X-Box. I don't really care about playing online, and with all these locked-out machines hitting the market at the same time, I figure I can get a great price.

In all honesty....when my Xbox broke...and I looked on craigslist to see about finding a temporary replacement...

Most of the "deals" I found on Craigslist were essentially "buy the box, get the games along with it." I didn't want the games, I just wanted el cheapo Xbox so I could play halo, but for the prices they were asking, I might as well go to the store and buy another that'd still be on warranty. It was only a good deal if you wanted the 5-10 games they were throwing in with it.

Your mileage may vary of course, this is just what I saw on local craigs list last month.

Haven't even hooked mine up to Live yet 'cause I don't have a long enough Ethernet cable, and I ain't payin' a hundred bucks for a wireless adapter. However, it's from Wal-Mart, so if I'm banned, there's a small problem. icon-fire.gif

Yep.
They do this sweep once a year. It's just getting attention because of the way it started as a rumor about earlyMW2 players. They always wait for a big release with online play to lure in the modders and then seep the systems.

Besides it's the holidays. Why drop priceswhen there's a ton of buers lined up already?

well were going to have to get a lot more picky at the store then. I had a guy come in the other day to buy a used 360 cause he said he got banned by MS for modding his 360. It wouldn't have been so bad he no came back 2 hrs later claiming that the one he just bought had already been modded, and then demanding his money back. Of course he was probably just bringing back his banned 360 in the same box. No one ever bothers to write down serial numbers over there.

I think it's just as likely that a lot of modders will want to buy NEW Xboxes, so they can play pirated single player games for free on their modded consoles, while only paying for the games they want to play online.

At only $200 for an arcade unit, it's still a bargain if you pirate only 4 full-priced games.
