QUOTE(Bowspearer)
Of late I seem to have attracted a few ebay sharks, and considering how bad some of them are, I thought I should warn everyone here so they don't also get stung by them.

First off, Ripple(Auction number 6009943497) : I bought a MASK Firecracker figure off him, and when I got him, I discovered that he'd used the helmet of the pilot to hide paint damage to the figure while also having a damaged rear gun which was also not shown. As the guy refused paypal for international sellers, I couldn't get my money back, and on top of that, the guy left me neg feedback in retaliation for the ebay complaint.

Then there's Jgallo(Auction number 5974788546). I bought a MISB Thunderclash from him and when he sent me the invoice, shipping was more than what he'd quoted in the auction. When I queried it with him, he claimed postage had just gone up and that he couldn't be expected to update all his listings. I then took it to ebay, as a seller isn't allowed to change the terms and conditions of the auction, the seller was forced to change the shipping price to what it was in the auction. As he'd cooperated, I left him +ve feedback. Today I found neg feedback where he'd claimed I was full of threats and problems, which is complete crap.

Last of all, and here's a real doosie, dtatomic (Auction number 6028734496) (this user has since changed their name to dtacustomz): I won a MASK Raven from him on ebay, and was quoted double the standard shipping costs. I contacted the seller over MSN messenger to discuss only sending the disk weapons which it came with as I really only needed those parts. Not only was the seller uncooperative about the shipping costs, but they claimed to be freaked out by me contacting them on msn (they actually flipped out completely when I pointed out that I could contact them over the phone under ebay's terms of use), refusing to sell the item and demanding that we both leave each other positive feedback. I refused. A few days later I contacted the seller, deciding to meet them half way, telling them I'd accept the whole item but there was no way I was letting them rip me off with shipping. They responded that he had gotten a new shipping amount from the post office, but now they were 2 hours away from home at university and had no way of getting the item to me, again demanding I leave feedback and not go ahead with the sale!

I stuck to my guns and he finally offered a different item in its place, Pirahna (http://www.albertpenello.com/mask/pir.jpg ) which while missing the windshield, was supposedly in working order with its figure. Deciding to be far more generous than ebay stipulates I had to be (according to ebay, I could have easily just stuck to my guns & demanded the original item), I let him send me this item instead.

When the item arrived, not only was the wrong figure provided (this was the figure he sent: http://www.albertpenello.com/mask/slyrax_pitstop.jpg) but the part for the submarine launching mechanism on the pack of the sidecar, which it & the sub form (on the first picture, it's the strut closest to you on the piece between the submarine & the bike). When I contacted the seller he said to send him pictures but that as far as he was concerned I'd just have to relist the item & hope for the best.

At this point I took out a paypal dispute as I could see that the seller had no intention of compensating me for the set in any way. Again with the dispute, I was too generous. Rather than demanding a full refund (which looking back I should have done) I said I'd settle for $17 out of the $20 I'd paid. After all I'd been sent a set which not only had the wrong figure supplied, but was essentially broken, & as far as tracking down an auction for the crucially damaged part goes, they never are sold alone. Also I fail to see why I should have to pay for shipping on an item which was anything but what I'd agreed to and that was as a stretch being nice. No sooner than I had filed the dispute though, that the seller had left me neg feedback & sent me two abusive emails. After the third, I sent back a blunt one essentially saying "no more Mr Nice Guy".

The guy tried falling back on the fact that the item wasn't insured, but the box was sealed and iundamaged, and the broken strut was nowhere to be found in the box, mmeaning that it was broken at the time it was being packed. In short, he's a buyer's worst nightmare.

Unless you want grief from these guys, keep away!
Bowspearer
Add Paypal themselves to this list. In the case of the dispute I filed with over dtatomic, not only did they neglect to ask for additional information (I have emails and msn messenger logs which prove my case) but they sided with the seller. Clearly their buyer protection policy isn't worth the space it takes up on their site! icon-megs.gif

Wheeljackslab.

It's interesting to note that all the positive things which I've heard people say about him seem to relate to domestic dealings, and here in the fan community in Australia, I have yet to hear of a single positive experience people have had with him.

A few months ago, I made the mistake of buying a G1 Brainstorm (6027507361) and Slapdash (6027507393) from him. First off, he'd said no paypal payments for international sellers with the auction yet had listed Bidpay as an option, which to be frank, was the only reason I bid on both items. When the auction ended I discovered that he hadn't done his homework on Bidpay and they had since shut down. This left me in a position of trying to find a relatively safe alternative to sending cash or a cheque, and in the process of doing so, he left me with a paymeny not received dispute on both items.

Fortunately at the same time, I'd managed to find a payment method which did at least cover me to some extent. I informed him on both items and both non paying bidder disputes were closed. About a week after this, I read the TFW2005 bad buyers thread and so I emailed him politely asking for clarification over concerns i had with his packing methods after reading about another Australian member's misfortunes over a G1 Shockwave he had acquired through him, only to be greeted not by the usual helpful and friendly tone of his emails, but by what was essentially a rant about how he ALWAYS packs Shockwave well and about "bad buyers". He also told me point blank that he indulges in retaliatory feedback on ebay. I should have realised that this would be the calm before the storm.

About a week and a half later (I can check dates on all of this later on if need be), Brainstorm arrived but not Slapdash, and one of the wingjoints on Brainstorm was VERY badly worn! I emailed him about both items and was told that because I didn't specify with the payment that it was for both auctions, it was my problem. With Brainstorm, he also insisted on me shipping it halfway round the world for me to inspect it so he could "consider" giving me a refund.

Now considering that this is exactly what had happened with this other member's Shockwave, naturally alarm bells went off. As for Slapdash, if it were a standard situation, then fair enough. However this was not a standard situation as he had unpaid item disputes on both items, and payment was sent to him for $110 (the quoted total for both shipped with insurance), where Brainstorm was worth $50 and Slapdash was worth $45. I learned from him at the end of things that he doesn't use any of the standard ebay tools, as in my ebay and his ebay inbox- things the average buyer would EXPECT from an ebay seller - at least when it doesn't suit him anyway. He also insisted on me sending over a money order for the additional shipping amount- the cost of which was as much as the shipping amount i was sending, rather than allowing me to send it through ebay. When I brought up paying the $8 I believed it to be at that time (the guy is very good at being difficult and intimidating via emails to the point where if he catches you off guard, it's very easy to get flustered and not be thinking straight).

Considering that I had tried resolving things with the seller and had been given an unsatisfactory result, I followed standard ebay proceedures and filed an "item not as described" and "item not received" disupte for Brainstorm and Slapdash respectively. This resulted in a "how dare you be so unreasonable" response from him. He then turned around and insisted on charging me a 20% penalty on a refund for a "restocking fee" for Slapdash, or he would "allow me" to choose another item of the same value. He also insisted on sending me the refund through paypal- which while seemingly being "the devil incarnate" when he receives money- it's perfectly ok when he's the one sending it. The figure he claimed was short though, and when I argued that he accused me of trying to con him. I had to scan in and send him my carbon copy of the money order to which I got a response of "Well how was I suposed to know you'd payed me that much?!", and an extremely grudging acceptance of the new amount. When I asked again about Slapdash, he argued that I didn't have the credit according to his 20% rule, yet at the time, the Auction for Slapdash was still active and won by me.

Feeling intimidated, I caved in at the time and accepted another item (which I now regret) and he went offline. About 2-5 minutes later, the intimidation faded and I argued a new proposal. As the shipping difference with the extra amount was such that there was a dfference of $3 US as far as the shippinmg cost for Slapdash went, as both items were still active (It's also worth noting that at this point, he'd banned me from bidding on any of his items, as I discovered when checking on the other item) and I had a worn wing joint which was not as described; I suggested partial compensation for $3USD for the wing joint damage which would take care of the shipping and that way there'd be a reasonable compromise.

To make sure the message was there before he came back online and cancelled the emails, I sent him a message through the "contact seller" option (as that way it would be instantaneous) saying that I'd changed my mind on Punch (the other figure I'd caved in on with) and that I proposed the above idea of a partial compensation for Brainstorm in the way of a shipping difference to square things up.

He then demanded we stick to the 20% option. When I refused to play ball on it as post auction extra charges like that are against Ebay TOU, he got nasty saying take Punch or the refund - 20% and that as he was blocking my email address from his email account after the next email and a reply from him, if I gave him an answer other than either option not only would I get no reply from him, but he'd decide what course of action he would take and I'd just have to live with it.

He sent me a refund, minus 20% for a "restocking fee from having to cancel both auctions" to an email address which wasn't even linked to my paytpal account. At this point, I was through being reasonable, and so I not only bounced his refund back, but filed an additional charges copmplaint with ebay, a false contact info complaint (his listed phonenumber at the time was disconnected) and left neg feedback, to which he carried through on his retaliatory feedback veiled threat.

About a week later I got an email from him, claiming he'd refund me the full price of Slapdash but insisted on keeping the $6USD and that I had better take this refund because there would not be another.

So not only did I wind up losing a whole night's sleep on this, but am now out of pocket and have a transformer which was not as described with a bad precedent in terms of having faith that if I retyurned the item he would actually inspect it in good faith and play fair on a refund; I'm also out of pocket.

While I can't speak for his domestic dealings and he may well be a dream to deal with in gthem; with international dealings, I can honestly say that he's a nightmare to deal with. In short, if you'll be dealing with him internationally; avoid him like the plague!

Won a complete set of UK Constructicons from him (6028998187) which I was told would take upto a month to get to me by standard airmail. A month later, no sign of them so I email the seller. The seller apologises saying that the reason they were late was because they request personal details from Paypal for accounts that show up as unverified. Now this would be on its own bad enough if it were just bad communication but the fact was that my accoutn had just been verified at the time as I'd had to increase my Paypal limits, making the check unnecessary at best and at worst a blatent lie!

I emailed the seller voicing my displeasure at what had transpired and that I found their paypal verification explanatiuon shaky at best as my account was verified. I received no reply. Recently I left neg feedback over the transaction considering the lateness of the item combined with not just a shaky excuse for it, but also piss poor communication on their part. This morning I woke up to find myself on the receiving end of retaliatory feedback.

Unless you want woeful communication, late items and deceitful excuses for the lateness, then avoid this seller like the plague.

I was browsing ebay and came across a Spider woman SDCC fig for $9.99 with $16 shipping... I was thinking in my head, WTF, why would it be $16 shipping. So I message the seller and I get...

"Don't bid if you do not like the cost of shipping. Shipping includes delivery confirmation and insuranse and handling plus my time. All of which is in accordance with ebay policy. Actually, do not bid on this or any of my items. Thanks anyway but now thanks."

I reply

"So your time equates to over double of standard shipping? Insurance for an item like this is a dollar. confirmation is 50 cents. You're tell me that the remaining money is for your time? I thank you for the evidence. I'll report you to ebay and see what they say. You're not the first to try something like this, and you won't be the last to get caught. Unless you're shipping it overnight, I highly doubt your cost is justified."

His/her contradictory response.

"Sounds interesting. I fail to see any of your points or why it is that you feel that you are going to go after us, but there are a long line of people just like you that have absolutely no life and nothing better to do, and further you never asked what shipping method I use, did you? Nope didn't think so. So go bark up another tree and not mine, these are highly exclusive items that only get shipped via USPS Express mail, not priority. You are such a loser.

And secondly while I am thinking about it, do you even know how much this figure weighs or how big it is? Of course not, because you simply are angry and hate the world. Your are a funny guy though, good luck in life and perhaps someday you will not be so much of a hater."

First off... Shipping method is mentioned in the auction. Priority. Cheap, fast, effect. Insurance = $1. Delivery Confirmation = $0.50. Yet shipping is $16 for a plastic figure weighing in at a pound, if that.

My reply:

I've replied to you and I know it's a PLASTIC Marvel select toy which weights less than a pound, give or take an ounce. Would you like to try your argument again? I'm not angry at anything. I'm not angry at you either, what I'm angry about is people abusing ebay trying to pull a fast one on FANS and parents of fans who want to buy a hard to find item for a loved one. You obviously rather make a buck or two more by charging extra on shipping. All you have to do is up the starting bid and be fair about shipping. However, it's obvious that you're not trying to be fair. As of June Ebay has become much more strict with the ruling of circumventing fees. Good luck if you plan to keep selling the way you're selling.

Sellers reply

Ah, there will always be people like you, and as always there will always be someone to go against someone else because they have no life whatsoever, you say that you are not angry and you claim that you are an upstanding citizen, huh? Interesting, I get it your the guy who wants to save the world one ebayer at a time. You are truly a joke. I find it amusing that you would waiste your time and mine with this nonsense. I pay more fees in a month than you probably make in a month at your job, funny huh? Your not angry? What would you call it, super dad witha grudge to bear against anyone that will not cowtow to what he believes is the proper way to do things, I am amazed that you made it through the way you are, you strike me a the kid that got his lunch money taken every day and had to run to the principals office to report the thieves, even worse you strike me as the person who would report a bumb asking for change. Whatever, I am used to dealing with people like you, haters and jealous people that cannot get what they want so they go around trying to drag down others that have. Your kind has been around from the dawn of time, the have nots, and that is just the way it is. Report and do whatever makes your boring life exciting and happy. But in all of that, do not email me again or contact me in any way, I need not waste another moment on a loser who only buys every once and a while and then thinks that they own ebay, news flash buddy, you do not own ebay nor are you a custodian, nor do you have any clue as to what you think that you know. Mr. Double id, oh yeah you did not think that I could figure that out huh? Have a pleasant, albiet pathetic life loser.

You are truly retarded, if you took the time to read the question attached to the listing which was a similar one that you have asked which was answered and posted. That response is my response and has been my response. This listing was supposed to be listed as express mail you retard so report all you like and do whatever makes you happy, just stop the emails because it is tiresome.

(He asks himself, "Why is shipping so high?" and then replies that he's sending it express mail to cover his behind after I've had this argument, further proving how wrong he is. Question and answer posted on the 26th.

BTW, do you have any idea how you sound, I will report you this, I will report you that? Does that jive really work with people, do they just roll over and lay down, really, get a life you spend entirely to much time as a robocop or some type of cyberpatroler, no one that has ever dealt with me or ever recieved any of the numerous free gifts and free gift wrapping and other things has complained, no but block one loser from your bids and now the world is going to end. Really it amazes me that people like you really are serious about things which you truly have no understanding of.

I purchased what I was told to be a G1 mint Hook but after paying for it and finally getting it i the mail it was clear it was a knock-off. I told the seller about it and they kept insisting that it was a true G1 and that they would not refund my money and as of yet Paypal hasnt made a decision.
AngstOverlord
enodiamond (300028444217)- Failed to actually purchase the paid-for shipping insurance despite a severe price-gouge. This was troublesome being their poor packing job broke a couple of the 'bots. Granted he did offer a fractional refund (like $5 for Mirage returned and $2.50 for a fixable Astrotrain) which was not comparable to what the insurance would have covered (repair/replacement AND you'd get to keep everything). $4 in actual shipping doesn't justify the $18-some postage plus the unpurchased insurance. Using butcher paper for packing (not even balled-up) just doesn't protect anything. I wanted reimbursement of at least a slight degree of what the insurance would have covered. He dropped the ball, accidental or not.

A bit long-winded, but hey. Being Paypal wanted a $25 mediation fee, I went directly through my credit company, who took care of everything.

Yeah, on Autocon I remember reading a lot of complaints about transactions with him in the past few months. My own personal experience was having to threaten him with a negative before he'd refund me the shipping difference on an ebay item that he had agreed to refund me prior to my bidding on the auction. His excuse was that he thought he had already sent me the refund, but that doesn't account for the lack of any communication over a period of several weeks during which I sent him at least 2 emails prior to the final one. Not someone I recommend buying from.

I was just reading his feedback. I like that:

* When Tyson made a Paypal complaint against him, he claimed that--because the complaint locked up the money in his Paypal account for that transaction--he can't spend the shipping money on shipping the item, but...

* When packages he sends out are myseriously "Lost" he has no problem refunding people their payments, shipping and all.

So apparently he doesn't have the money to ship items, but somehow has the money to refund payments, including the shipping cost that he already supposedly "spent" shipping out the lost items.

Also, it's amazing the number of packages he claims are "Lost" in the mail. It's just a ridiculous amount. Either he goes to the worst post office ever or he's not sending out the packages.

I just won auctions for two of his ARC prototypes a couple of weeks ago but PayPal didn't inform me that payment was made until last week (although the money was debited almost a week prior). I just received
an email from him last night saying he was out of town and I'd be receiving my CyberFembots by the end
of the week. Although I, too, was skeptical due to the "lost in mail" feedback replies, I'm willing to give him
a chance to make good on this and give him the week before taking any legal action. I have no reasons to doubt his sincerity personally at this time as I have had good dealings with several so-called "bad dealers" listed in this thread (Wheeljack'slab for one) so I'm not ready to call "foul" just yet.

I'll post back on Monday whether I've received my package or not and keep everyone informed for the good
or bad.

Wow... No need to sic your dad on me.

Sorry if I got the e-mail accounts mixed up. I got your letter via my hotmail account and replied, then I sent mail back through Ebay, which you apparently got.

Again I'm very sorry for the delay, I am shipping your Primus this week and you should have it by Friday.

Here are his lame excuses, in order of appearance:

1.) Sorry, can't pay you - my PayPal ran out of money. WTF?
2.) One week later: Wah wah wah, I don't know where and how to get money order (fine, this is legit, but he never intended to follow through.)
3.) A few days later: Wah wah wah, too hard, I'll have to go "investigate" this whole money order thing. Where do I get it again?
4.) A few days later: What's your mailing address?
5.) Stops responding to my requests for a payment update
6.) Does not respond to Ebay Unpaid Item Dispute.
7.) I get back Final Value Fee credit and leave negative feedback.

Hey! I promised an update and here it is.

I just received my A.R.C.s this afternoon...just two days after both Hal and I were ready to file an insurance claim with the Post Office. They were very well packed in a large box full of shredded paper and the models
themselves were wrapped in cellophane and encased in two styrofoam cups taped together to protect the
contents. Honestly, while it seems a bit unconventional, it works and I don't think they could've been more
protected. OK, maybe if you replaced the cellophane with bubble wrap but that would've been overkill.
I thought at $16 the shipping was a bit high at first but the actual shipping was $11.50 plus $3.50 for insurance so he made *maybe* $1 on shipping.

I'm VERY satisfied and I'm proud to announce that Hal Zucati lived up to his end of the deal.
Highly recommended!

I sold a very mint Fortress Maximus Cerebro for $108 to this thief. He sent payment, I sent the transformer. One day after what the post office's estimate would put the date of delivery at, he files a paypal dispute and, two minutes later (so as to give me no time to respond) he escaltes it into a claim, saying he never received the item and that he tried to contact me numerous times about it. I never received a single message or email from him inquiring as to when the part would be delivered, and I received plenty of other ebay and paypal messages during that time.
I then contacted him by the email address that the claim provided me and asured him that I had sent the package. He responded in a highly rude manner several days later. I emailed him again trying to find a way to resolve the situation, and he sent back one line saying that he wouldn't drop the claim (...again, several days later...doesn't seem overly concerned...)

Well, unfortunately, since I did not buy a tracking number for this package, and that's the only proof paypal will take, I lose my money and a very rare part. Those of you who know me know I'm not in the business of ripping people off. Those who don't, I have flawless ebay payment (though I do expect a retalitory neg from this guy since I just neg'ed him) and tons of positive feedback on yojoe.com and joecustoms.com (I am primarily a joe collector) and no negative. From Paypal website:
QUOTE
What can I do if I believe a buyer's claim is fraudulent?

We want to know if you believe that a buyer's claim is fraudulent. PayPal takes action against buyers who file fraudulent claims and we welcome any information you might be able to provide. Once a case is closed, you will be able to report a fraudulent claim through the "Report Fraud" link on the Claim Details page.

The best way to avoid liability due to fraudulent claims is to follow the Seller Protection Policy guidelines. These "best practices" help ensure that PayPal has the information it needs to successfully prove a fraudulent claim.

I highly doubt anything will come of it but you can state your case. Paypal really does suck .

DO NOT PAY THIS GUY!

Here's the email he sent me:

Oh, My, God,

Long story short I've been out of town and things have been tight for money, I know lame exuses but really I just want you to know whats up. Please don't worry and let me know when your piece arrives...

- Hal

I told dude my POPS was a lawyer. Now I paid the guy 3 weeks ago. How can you be out of town and put new items up for sale daily? FISHY!!!!!!!!

What this guy isn't telling you is that because of the trouble getting this package out on time and all the fuss we went through is that I refunded the purchase price of Primus to him fully... WHILE trying to get information on where Primus was.

This person, not sure if it was a HE then RECEIVED Primus in good order and DID NOT return the money I'd sent in good faith thinking Primus had been lost...

Check it out....

I've sent many e-mails to this person and have not recieved on reply... He got My Primus AND my money.

Who's the victum here? No this whiny lying scum.

Check it.

Over 200 Ebay purchases and I have experienced my first Bad Ebayer! I won auction 320143493704 on August 2nd, sent payment on August 3rd. Seller confirmed receipt of payment on August 9th, after I emailed to ensure that payment had been received. At that time seller indicated that the item would be shippped on either August 10th, 11, or the 13th. Well it is September 4th , I have not yet received the item and the seller has not replied to the email I sent on August 27th asking if he have been able to ship my purchase yet. I have a feeling he sells items on ebay and then goes out to purchase the item, in other words he does not have the items he lists "on-hand". It seems that his most recent feedbacks involving new items all receive neutral or negative feedback. So, if you run accross seller "MYVINTAGECHEVY", think twice about ordering anything that you expect to receive in a timely manner.

This is pretty typical, Shipping for whatever reason in my neck of the woods is the worst ever. If I charge more and send via UPS no problem... but USPS... mother of god... it takes FOREVER some times...

No tricks or BS. Just hanusly slow USPS shipping. In cases like this I'd ask that the buyer contact me direclty and work it out. I'm happy to refund shipping charges in cases like this.

Do not know if thus is the best place to leave this, but if you do business in ebay please beware with user Casper_085, she is from Australia and is dangerous, she received one of my Ironhide & ratchet head sets and with no previous communication with me left me a negative ruining my perfect record of 100% positive.

I am aware that is someone gets screwed by a seller you have the right to leave a negative feedback but after contacting the seller to claim why you are disatisfied, the negative says that my add is misleading, but from all the almost 50 pairs sold she is the only one that understood that the toys were included- even whe the add clearly states that the figures are not included- (I assume that's what she is claiming because up to now i do not understand why).

so I hope this feedback helps you all and if you get to do business with her do not burn because she will not understand your auctions!

If dealing on eBay, avoid the seller remad7. I bought a Centurions Doom Drones Strafer from the guy which was supposedly NRFB, only when I got it, I discovered that the tape holding down one of the tabs had been sliced apart.

I approached the seller about it only to have him be combative, abusive and libellous, threatening to name me personally in his ebay listings if I left him negative feedback, which I did.

However it seems that it wasn't an empty threat as the guy responded by listing my name, residential address and phone number in one of his item listings and slandering me. Fortunately eBay removed that listing promptly, however I don't trust him to stop there, and I'd strongly recommend no longer dealing with him, unless you want your personal contact details splashed across multiple eBay listings.

Seller: ajmzekeinc

Item number: 270390233773

Bought a sealed Captain Power Dread Stalker from him. Auction stated flap was slightly bent. When I received it, the flip had been bent completely to ship to the point where the internal cardboard layers had completely snapped. Seller claimed they were doing me a favour by trying to keep shipping costs down and blamed me for not emailing them before the invoice to tell them I didn't want the packaging mutilated when the item was shipped.

Steer clear if you want anything boxed or carded from this guy!

Seller: Primy101

Item number: 120421860407

Bought a sealed Matt Trakker/Miles Mayhem 2-pack from him. Arrived today with the bubble holding the Spectrum mask dented in the top right corner and running almost the whole distance along the top- something not indicated in the item photo. In addition, the seller overcharged on shipping.

Box shows no sign of damage- meaning that the damage had to have taken place either during packing or before then. Seller is claiming that the item was sold "as is" and blaming it on shipping, claiming it's my fault for not having insurance (even though insurance wouldn't have covered this as the shipping box wasn't damaged).

Currently in the middle of a paypal dispute- watch out for this guy as he's currently listing transformers!

EDIT: Seller (Primy101) sent partial refund of $15 to compensate for damage. Seems to require a bit of a push to get a resolution but seems to be reasonable in the end.

ebay seller "daddydineros"-Bought and paid for a Toy Story 2 Mega Morphers Rex,never received it,contacted seller and was told item was delivered and stolen by neighbors(no tracking number was given to find out delivery date),was told 2nd item was sent and again never delivered and seller insisted was stolen by neighbors or mail carrier never left item(again no tracking number to check),and finally refused to refund money or send another figure of equal value.
